Considering Surrendering

We hope this doesn’t happen, but sometimes, due to a job change, house purchase or unforeseen circumstance, you may want to try and reach an agreement to end your responsibility for the property earlier than the date of the end of your tenancy. This is called “surrendering” your tenancy.

You will have to agree to the terms, fees, and conditions before you make your decision. Your landlord is not legally obliged to accept any offer from you to end your tenancy early. Please read your Tenancy Agreement.

Your offer to seek to end the tenancy early must be in writing. If accepted, you would only be released from the tenancy when Finders Keepers have re-let the property and the new Tenancy Agreement has been fully signed by all parties. A fee of 50% of a month’s rent + VAT is payable by you and due in advance.

You would have to agree to move out of the property 5 working days before any new tenancy starts. During this time, you would still be responsible for the rent and utilities.

“Surrendering” is not possible in student properties with less than 7 months of the tenancy remaining.

What should I do if I part company with the other tenant(s)?
Under the terms of the agreement the named tenants are ‘jointly and severally’ responsible. In other words: all for one and one for all. This means that each individual named tenant can be held responsible for the entire property and the total rent.

One party may be able to take over the whole tenancy, or you may be able to find a suitable alternative tenant to apply to take over the tenancy from you. This would be subject to agent and landlord approval plus satisfactory references and credit checks.

There is a process and a fee payable (see our Schedule of Fees here). Please talk to your Property Manager. The new tenant should pay their agreed share of the deposit to the outgoing tenant in these circumstances. The new tenant should satisfy themselves that the deposit held is correct.

If the situation involves the break-up of a relationship, you may want to explore the possibilities of surrendering the tenancy. Approach your Property Manager as soon as possible and we will do our best to help.
